eaPart 3Overpayment Credit ElectNotice Response

Can a wrong credit elect be moved back to the original year?

A wrong accepted return applied too much overpayment to next year's estimates. The prior year now shows penalties even though the taxpayer made payments. How should I frame this?

Frame it as an account-reconciliation problem, not just a return-preparation problem. Once an overpayment is elected to the next year's estimated tax, the IRS account may treat it as activity for the following year. Whether and how it can be corrected depends on the account transcript, the return correction path, the filing status of the following year, and current IRS procedures.

The EA should gather:

  • the accepted wrong return;
  • the correct return computation;
  • payment records;
  • account transcripts for both years;
  • any IRS notices; and
  • the Form 8879 and transmission log.

Then respond through the appropriate amended or superseding return path and notice procedure. Do not promise that the credit can simply be pulled back without reviewing the account.
