What facts point toward employee status in a worker-classification question?
I know control matters, but I need a cleaner way to recognize employee facts in an EA-style question.
Look for facts showing the business has the right to direct and control the work. Employee-leaning facts may include required hours, required work location, detailed instructions, required training, close supervision, tools provided by the business, payment by time period, benefit eligibility, and work that is integrated into the business's regular operations.
No single factor controls every case. A written contractor agreement or 1099 form may matter, but it does not override facts showing an employer-employee relationship. The exam answer should weigh behavioral control, financial control, and relationship facts together.
